Senior Counsel, Trademark & Brand Protection

Location: This position will be located in Leatherhead, UK. 

Job Summary:

Western Digital is an industry-leading provider of storage technologies and solutions that enable people to create, leverage, experience and preserve data.  Western Digital’s trademarks, logos and slogans are valuable assets that distinguish our products from those of our competitors.  Western Digital has a global brand protection team focused on protecting against unauthorized or improper use of those assets.  This role will work on strategy and implementation of various global online and offline brand protection programs to remove counterfeit or unauthorized products from retail and supply channels, enforce against warranty and retail fraud and protect and enhance the Western Digital brands.  This position will also support and coordinate with the Trademark Prosecution team.    

Duties & Responsibilities:

  • Implementing brand protection programs in specific jurisdictions within the construct of the global company strategy
  • Managing pre-litigation enforcement activity including cease and desist letters, notice and takedown requests, commercial correspondence, and negotiating settlements
  • Managing criminal and civil pre-litigation activities, such as raids and investigations, as well as participating in litigation case activities, such as attending hearings, depositions, or trials, as needed
  • Overseeing investigations including advising on strategy, drafting documents, interviewing internal witnesses and experts, compiling and presenting data, and authenticating products as part of pre-litigation, litigation and/or general enforcement activities
  • Conducting factual research of infringing activity, including orchestrating test buys, identifying illicit behavior, identifying counterfeit products, and performing or coordinating further product testing and analysis
  • Collecting and preserving evidence of wrongdoing to maintain availability of all enforcement options
  • Partnering with internal and external teams to identify new targets and fraudulent activities globally
  • Collaborating with external partners such as customs, state and federal law enforcement agencies and managing outside counsel
  • Maintaining and ensuring ethical standards and professional conduct of internal and external investigations
  • Identifying and prioritizing jurisdictions for new enforcement options and implementing them
  • Using internal and external digital tools to effectively manage cases, report results, and measure return on brand protection and enforcement activity

Education and Experience Profile

  • Completion of a law degree (LLB) from a qualified university, followed by any required training
  • Qualification as a lawyer under local qualification rules
  • 5-8 years of relevant experience in a law firm and/or in-house legal department
  • Multi-lingual; German language desired
  • Experience handling litigation matters, including evidence preparation and preservation and managing case deadlines
  • Experience handling external investigations in the context of litigation desired   
  • Working knowledge of trademark law and experience in brand protection
  • Familiarity with British and European legal systems; knowledge of foreign jurisdictions desirable
  • Experience working in or with technology companies or in the technology industry a plus
  • Interest in working with technology products, learning about technology and keeping up-to-date with brand protection tools and technology
  • Interest in learning about the laws of foreign jurisdictions, willingness to travel (when safe to do so) and to be flexible with respect to taking calls with team members in other time zones
  • Strong attention to accuracy, quality, details, and strong analytical skills
  • Strong organizational and time management skills
  • Has a customer service focus and works collaboratively with internal partners
  • Attentively listens to others and encourages the open expression of diverse ideas and opinions
  • Provides timely and helpful information to others across the organization

  • Drives results while independently performing tasks and making recommendations regarding appropriate courses of action to functional leaders and client groups
